Q: The ______ Amendment garantees the right of the people to be free from search and seizure of their persons, houses, papers, and effects.
A. There is no amendment that grants such a right. The 4th Amendment grants the people the right to be free from “unreasonable” searches and seizures but no right to be free from search and seizure exists. If you said the 4th Amendment do not give yourself a point.
How did you fare? In 1996 when I originally gave this test to 50 people (21 “Conservatives”, 13 “Moderates”,
15 “Liberals”) the following percentages answered correctly:
Total Respondants: 42% (21)
“Conservatives” 86% (18)
“Moderates” 15% (2)
“Liberals” 7% (1)
