It is OK to Steal by Jeff Jackson (2/02/04)
The Land of the Free - A Conservative Politics Web Site

During the Super Bowl, Pepsi sent a terrifying message to our children.  That message?  That if you commit a crime, you too can be rewarded with your face on TV and money in your pocket.  When the RAAA started cracking down on thieves of digital music legally designated as copy written material, it was certain that they never imagined that any American company would exploit the criminals that they prosecuted to protect their own guaranteed rights.

Pepsi in the their infinite wisdom to promote their “legal” download service took these criminals that made thousands of free songs available FREE and in VIOLATION of even the most liberal definition of “fair use” and made them stars.  And while making them stars, provided them a platform to brag about their exploits and that they would continue to download FREE music (this time actually legally via a Pepsi promotion) and that there was nothing that could be done about it.

No admission of wrongdoing.  No message to their peers that stealing was wrong.  No admission that they were sorry for stealing.  No remorse at all.

No, such things would have detracted from the overall message and that was break the law, get rewards.  That message was it wasn’t so bad.

Be clear on this.  Pepsi giving people the opportunity to download music “free” through their promotion is not so bad.  It is not so bad because the music that will be available is not really “free”.  It is paid for when one buys Pepsi products.  The fact that they try to pass it off as “free” is another pet peeve of mine for a rant another day because it plays into the misconception many have that something is actually “free” when it is paid for.

No, the problem is that Pepsi chose to use criminals to promote their program.  The problem is that to use criminals to promote it and then brag that there is nothing that can be done about it is counter productive.  Such things diminish the fact that they were caught stealing even when they KNEW it was wrong.  The problem is that Pepsi now shows us that you too can profit from breaking the law.
