References to the right to be reasonably secure in your private property, person and possessions from unreasonable searches and seizures and a right to require an issued warrant or act of the elected legislature for nonconsentual searches and a further right to compensation and due process of the law if property is to be taken for public use can be found in:
  1. 4th Amendment to the United States Constitution “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”
  2. Virginia Declaration of Right, Section VI, “That elections of members to serve as representatives of the people in assembly ought to be free; and that all men, having sufficient evidence of permanent common interest with, and attachment to, the community have the right of suffrage and cannot be taxed or deprived of their property for public uses without their own consent or that of their representatives so elected”
  3. Virginia Declaration of Rights, Section X, “That general warrants, whereby any officer or messenger may be commanded to search suspected places without evidence of a fact committed, or to seize any person or persons not named, or whose offense is not particularly described and supported by evidence, are grievous and oppressive and ought not to be granted”
  4. Pennsylvania Declaration of Rights and Constitution Section VIII, “But no part of a man’s property can be justly taken from him, or applied to public uses, without his own consent, or that of his legal representatives”
  5. Pennsylvania Declaration of Rights and Constitution Section X, “That the people have a right to hold themselves, their houses, papers, and possessions free from search and seizure, and therefore warrants without oaths or affirmations first made, affording a sufficient foundation for them, and whereby any officer or messenger may be commanded or required to search suspected places, or to seize any person or persons, his or their property, not particularly described, are contrary to that right, and ought not to be granted.”
  6. 5th Amendment to the United States Constitution “nor shall private property be taken for public use, without just compensation”
  7. The Declaration of Arms, " In our own native land, in defence of the freedom that is our birthright, and which we ever enjoyed till the late violation of it -- for the protection of our property, acquired solely by the honest industry of our fore-fathers and ourselves, against violence actually offered, we have taken up arms."
  8. Massachusetts Body of Liberties Section VII, “No mans Cattel or goods of what kinde soever shall be pressed or taken for any publique use or service, unlesse it be by warrant grounded upon some act of the generall Court, nor without such reasonable prices and hire as the ordinairie rates of the Countrie do afford.  And if his Cattle or goods shall perish or suffer damage in such service, the owner shall be suffitiently recompenced.”
  9. The Northwest Ordinance Article II, "should the public exigencies make it necessary, for the common preservation, to take any person's property, or to demand his particular services, full compensation shall be made for the same.  And, in the just preservation of rights and property, it is understood and declared, that no law ought ever to be made, or have force in the said territory, that shall, in any manner whatever, interfere with or affect private contracts or engagements, bona fide, and without fraud, previously formed. "
  10. Fairfax County Resolves "11. Resolved that we will cordially join with our Friends and Brethren of this and the other Colonies, in such Measures as shall be judged most effectual for procuring Redress of our Grievances, and that upon obtaining such Redress if the Destruction of the Tea at Boston be regarded as an Invasion of private Property, we shall be willing to contribute towards paying the East India Company the Value"
  11. The Rights of the Colonists by Samuel Adams "In the state of nature men may, as the patriarchs did, employ hired servants for the defence of their lives, liberties, and property"
  12. The Rights of the Colonists by Samuel Adams "Thirdly, The supreme power cannot justly take from any man any part of his
    property, without his consent in person or by his representative."
  13. A FRAGMENT OF FACTS, DISCLOSING THE CONDUCT OF THE MARYLAND CONVENTION,ON THE ADOPTION OF THE FEDERAL CONSTITUTION. ADDRESS TO THE PEOPLE OF MARYLAND "8. That all warrants without oath, or affirmation of a person conscientiously scrupulous of taking an oath, to search suspected places, or seize any person or his property, are grievous and oppressive; and all general warrants to search suspected places, or to apprehend any person suspected, without naming or describing the place or person in special, are dangerous, and ought not to be granted."
  14. RESOLVES ADOPTED IN CHARLOTTE TOWN, MECKLENBURG COUNTY, NORTH CAROLINA,MAY 31, 1775 "7.  That upon the Complaint of any Person to either of these Select Men, he do issue his Warrant, directed to the
    Constable, commanding him to bring the Aggressor before him or them to answer the said Complaint."
  15. Ratification of the Constitution by the State of North Carolina November 21, 1789 "That there are certain natural rights of which men, when they form a social compact, cannot deprive or divest their posterity, among which are the enjoyment of life, and liberty, with the means of acquiring, possessing,and protecting property, and pursuing and obtaining happiness and safety."
